The Intestacy Rules

If you die without making a Will the intestacy rules will apply to the distribution of your estate. The distribution of the estate depends on the category of relatives that you leave behind.

You have a spouse/civil partner and no children:

Spouse or civil partner gets everything. 

 You have a spouse or civil partner and children:

  • Spouse/civil partner gets:
    • All personal possessions
    • The first £250,000 from the estate
    • Half of the remainder of the estate
  • Children will share the other half of the remainder of the estate
You have children and no spouse/civil partner:

Children get everything. Linear descendants of any pre-deceased child get his/her share.

 You have no spouse/civil partner or children:

Parents get everything and if both are alive they share equally.

 You have no spouse/civil partner, children or parents:

Full brothers and sisters will share equally. Linear descendants of any pre-deceased brother or sister get his/her share.

You have no spouse/civil partner, children, parents or full brothers and sisters:

Half brothers and sisters will share equally. Linear descendants of any pre-deceased half brother or sister get his/her share.

You have no spouse/civil partner, children, parents, full brothers and sisters or half brothers and sisters:

Grandparents share equally.

You have no spouse/civil partner, children, parents, full brothers and sisters, half brothers and sisters or grandparents:

Aunts and uncles will share equally. Linear descendants of any pre-deceased aunt or uncle get his/her share.
